This Shipping Policy applies to purchases made from First Game Limited through firstgameltd.com or through any direct business communication with our company.
First Game Limited sells in-stock and customized product shells from China to business customers worldwide, mainly in the USA and Europe.
1. B2B Shipping Policy
First Game Limited sells to business customers only.
By placing an order, the buyer confirms that they are purchasing for business, resale, distribution, repair, modification, customization, or other commercial purposes, and not as a consumer.
This Shipping Policy applies to B2B commercial transactions.
2. Shipping Origin
Most orders are shipped from China.
Depending on the product type, production arrangement, stock availability, destination country, and logistics conditions, goods may be shipped from our warehouse, supplier facility, production partner, or another location arranged by First Game Limited.
3. Order Processing
Orders are processed only after full payment has been received and cleared.
Processing time may vary depending on:
- Product availability
- Order quantity
- Customization requirements
- Production schedule
- Packaging requirements
- Buyer confirmation time
- Logistics arrangement
In-stock products are usually processed faster than customized products.
Customized products require additional time for confirmation, production, inspection, and preparation before shipment.
4. Pre-Dispatch Confirmation
Before dispatch, First Game Limited may provide photos and/or videos of the goods for buyer confirmation.
The confirmation materials may include product appearance, color, quantity, packaging, customization details, or other visible order information.
Once the buyer confirms the goods for dispatch, the order will be considered accepted for the visible details shown in the confirmation materials.
This does not exclude valid claims for hidden defects, wrong shipment, or issues that could not reasonably be identified from the pre-dispatch confirmation materials.
5. Shipping Methods
We may ship orders through international courier, air freight, sea freight, railway freight, truck delivery, buyer-appointed freight forwarders, or other logistics methods agreed by both parties.
Common logistics providers may include international express carriers, local carriers, freight forwarders, or third-party logistics companies.
The final shipping method depends on:
- Destination country or region
- Product type
- Shipment weight and volume
- Customs requirements
- Buyer’s requested delivery method
- Logistics cost
- Carrier availability
- Current international shipping conditions
If the buyer uses their own freight forwarder or shipping agent, the buyer is responsible for coordinating with the forwarder and ensuring that the forwarder can properly handle the shipment.
6. Shipping Time
Any shipping time provided by First Game Limited is an estimate only and is not guaranteed unless expressly agreed in writing.
International shipping time may be affected by:
- Customs clearance
- Destination-country regulations
- Carrier delays
- Flight, port, or route availability
- Peak season congestion
- Weather conditions
- Remote-area delivery
- Import inspection
- Government orders
- Force majeure events
First Game Limited is not responsible for delays caused by carriers, customs authorities, freight forwarders, destination-country import procedures, or events beyond our reasonable control.
7. Shipping Costs
Shipping costs are usually calculated based on shipment weight, volume, destination, shipping method, and carrier quotation.
Unless otherwise agreed in writing, the buyer is responsible for all shipping costs.
Additional charges may apply for:
- Remote-area delivery
- Address correction
- Re-delivery
- Storage
- Oversized packages
- Special packaging
- Customs inspection
- Return shipping
- Failed delivery
- Carrier surcharges
- Fuel surcharges
- Other logistics-related costs
Shipping fees are generally non-refundable once the shipment has been dispatched.
8. Customs Clearance Responsibility
The buyer is responsible for all customs clearance matters in the destination country or region unless otherwise agreed in writing.
This includes, but is not limited to:
- Ensuring the goods can be legally imported into the destination country or region
- Providing accurate shipping and import information
- Handling customs clearance procedures
- Providing required import documents if requested by customs, carrier, or broker
- Communicating with the carrier, customs broker, or local customs authority when required
- Paying any applicable import duties, import VAT, tariffs, customs fees, brokerage fees, taxes, storage fees, or other local charges
First Game Limited is not responsible if the goods are delayed, rejected, returned, confiscated, seized, destroyed, or otherwise unable to pass customs clearance due to destination-country regulations, buyer-side import restrictions, missing buyer documents, unpaid import charges, or any other customs-related issue outside our control.
If the buyer refuses delivery, fails to complete customs clearance, provides incorrect shipping information, fails to provide required documents, or fails to pay required import charges, any resulting loss, delay, return shipping cost, storage fee, customs charge, handling fee, or product loss shall be the buyer’s responsibility.
9. Import Duties, Taxes, and Local Charges
Import duties, import VAT, tariffs, customs fees, brokerage fees, taxes, and other local charges are not included in the product price or shipping fee unless expressly agreed in writing.
These charges are the buyer’s responsibility and are non-refundable.
First Game Limited is not responsible for estimating, collecting, or paying destination-country import duties, VAT, tariffs, taxes, customs fees, or brokerage fees unless otherwise agreed in writing.
10. Incorrect Shipping Information
The buyer is responsible for providing complete and accurate shipping information.
This may include:
- Company name
- Contact person
- Phone number
- Email address
- Full delivery address
- Postal code
- Tax ID, VAT number, EORI number, or other import information if required
- Freight forwarder information if applicable
First Game Limited is not responsible for delivery failure, delay, return, loss, customs issue, or additional cost caused by incorrect, incomplete, or outdated shipping information provided by the buyer.
Any additional cost caused by incorrect shipping information shall be the buyer’s responsibility.
11. Delivery, Risk, and Title
Unless otherwise agreed in writing, delivery risk transfers to the buyer once the goods are handed over to the carrier, logistics provider, or buyer-appointed freight forwarder.
If the buyer appoints their own freight forwarder or shipping agent, First Game Limited’s delivery responsibility is generally completed once the goods are handed over to the buyer’s appointed forwarder or agent.
First Game Limited may assist with tracking and communication where commercially reasonable, but we are not responsible for carrier-side delay, loss, damage, customs issue, or delivery failure after the goods have been handed over to the carrier or buyer-appointed forwarder, unless the issue was caused by First Game Limited.
12. Split Shipments
First Game Limited may ship an order in one or multiple shipments depending on stock availability, production schedule, packaging requirements, logistics arrangement, or buyer request.
If an order is split into multiple shipments, each shipment may have separate tracking information, shipping cost, customs clearance process, and delivery time.
13. Damaged, Missing, Wrong, or Defective Goods After Delivery
The buyer should inspect the shipment immediately upon delivery.
For any claim involving damaged goods, missing items, wrong items, packaging issues, or visible defects, the buyer must contact First Game Limited within 3 calendar days after delivery.
The buyer must provide sufficient evidence, including:
- Order number or invoice number
- Clear photos of the issue
- A clear and continuous open-box video
- Photos of the shipping label
- Photos of the outer packaging
- Photos of the inner packaging
- Description of the issue
The open-box video should show the unopened package, shipping label, outer packaging, inner packaging, and the product issue.
If the buyer cannot provide sufficient evidence, especially an open-box video where reasonably required, First Game Limited may reject or limit the claim.
After receiving sufficient evidence, First Game Limited will review the case and negotiate a reasonable after-sales solution with the buyer.
Possible solutions may include replacement parts, replacement goods in a future shipment, repair support, technical guidance, discount, store credit, partial refund, or other commercially reasonable solutions agreed by both parties.
14. Lost, Delayed, Returned, or Failed Delivery
First Game Limited will try to assist the buyer with tracking and logistics communication where commercially reasonable.
However, First Game Limited is not responsible for shipment loss, delay, return, seizure, destruction, or failed delivery caused by:
- Carrier error
- Customs clearance failure
- Buyer’s failure to pay duties, taxes, or local charges
- Buyer’s failure to provide documents
- Incorrect shipping information
- Buyer’s refusal of delivery
- Destination-country import restrictions
- Government inspection or regulatory action
- Buyer-appointed freight forwarder issues
- Force majeure events
- Other events beyond our reasonable control
If the shipment is returned to China or another location due to buyer-side reasons, the buyer is responsible for any return shipping cost, re-shipping cost, customs charge, storage fee, handling fee, and related loss.
15. Force Majeure and Events Beyond Our Control
First Game Limited shall not be liable for any delay, loss, damage, failure of delivery, non-performance, or partial performance caused by events beyond our reasonable control.
Such events may include, but are not limited to:
- War, conflict, military action, terrorism, or civil unrest
- Natural disasters, extreme weather, earthquake, flood, fire, epidemic, or pandemic
- Government orders, sanctions, import/export restrictions, customs policy changes, or regulatory actions
- Port congestion, carrier suspension, shipping route disruption, logistics interruption, or transportation accidents
- Labor strikes, shortage of transportation capacity, power failure, or other events beyond our control
If any such event affects the shipment, delivery, customs clearance, or performance of an order, First Game Limited will try to communicate with the buyer and assist where commercially reasonable.
However, any delay, additional cost, loss, seizure, destruction, or failure of delivery caused by such events shall not be the responsibility of First Game Limited unless otherwise agreed in writing.
16. Buyer-Appointed Freight Forwarders
If the buyer requests to use their own freight forwarder, shipping agent, warehouse, or logistics provider, the buyer is responsible for confirming that the forwarder can accept, handle, export, ship, and deliver the goods properly.
Once the goods are handed over to the buyer-appointed forwarder, shipping agent, warehouse, or logistics provider, First Game Limited is not responsible for any loss, damage, delay, customs issue, delivery failure, or additional cost caused by that forwarder or agent.
17. Restricted or Prohibited Imports
The buyer is responsible for checking whether the ordered goods can be legally imported, sold, distributed, modified, or used in the destination country or region.
First Game Limited is not responsible if the goods are restricted, rejected, detained, seized, destroyed, or returned by customs or other authorities due to destination-country laws, regulations, import restrictions, intellectual property concerns, product compliance requirements, or buyer-side import limitations.
18. No Guaranteed Delivery Date
Unless expressly agreed in writing, First Game Limited does not guarantee a specific delivery date.
Any delivery estimate provided before or after shipment is for reference only.
Delays caused by logistics providers, customs authorities, weather, force majeure events, or other factors outside our control do not entitle the buyer to cancel the order, reject the goods, or claim compensation unless otherwise agreed in writing.
