This Business Customer Policy applies to all business transactions with First Game Limited, including purchases made through firstgameltd.com, direct communication, quotations, invoices, and custom order arrangements.

First Game Limited sells in-stock and customized product shells from China to business customers worldwide, mainly in the USA and Europe.

1. B2B Sales Only

First Game Limited sells to business customers only.

By using our website, requesting a quotation, placing an order, confirming production, or making payment, the buyer confirms that they are purchasing for business, resale, distribution, repair, modification, customization, or other commercial purposes.

The buyer confirms that they are not purchasing as an individual consumer.

2. Business Buyer Confirmation

By placing an order with First Game Limited, the buyer confirms that:

  • They are acting for business or commercial purposes;
  • They have authority to purchase on behalf of their company or business;
  • All information provided to First Game Limited is accurate, complete, and up to date;
  • They understand that the transaction is a B2B commercial transaction;
  • They agree to this Business Customer Policy, our Terms of Service, Shipping Policy, Refund & Returns Policy, and Privacy Policy.

3. Product Types

First Game Limited may supply two main types of products:

In-Stock Products

In-stock products are standard products that may be sold to multiple business customers.

These products are usually available for faster processing and shipment, subject to stock availability and order quantity.

Customized Products

Customized products are products made, modified, colored, printed, packaged, or arranged according to customer-specific requirements.

Customized products may include, but are not limited to:

  • Made-to-order shells
  • Customer-specific designs
  • Custom colors
  • Logo-printed products
  • Private-label products
  • Modified shells
  • Special production requests
  • Products made according to customer-provided specifications

4. Customized Products Are Final Sale

Customized products are final sale once the order details, specifications, design, sample, quotation, invoice, or production arrangement have been confirmed.

After confirmation or production starts, customized products generally cannot be cancelled, returned, refunded, or exchanged.

This includes, but is not limited to, cases involving:

  • Change of mind
  • Incorrect customer selection
  • Design preference changes
  • Market changes
  • Customer-side resale issues
  • Customer-provided specification errors
  • Customer-provided artwork, logo, or design mistakes

5. Order Confirmation and Buyer Responsibility

The buyer is responsible for carefully checking all order details before confirming an order.

This may include:

  • Product model
  • Color
  • Quantity
  • Logo
  • Artwork
  • Design file
  • Material
  • Packaging
  • Labeling
  • Customization details
  • Shipping information
  • Import information
  • Production requirements

First Game Limited is not responsible for errors, delays, losses, or additional costs caused by incorrect, incomplete, unclear, or late information provided by the buyer.

6. Payment Methods

First Game Limited does not accept credit cards.

Accepted payment methods may include:

  • Bank transfer
  • Cryptocurrency
  • WeChat Pay
  • Alipay
  • Other payment methods agreed by First Game Limited in writing

Orders will only be processed after full payment has been received and cleared, unless otherwise agreed in writing.

The buyer is responsible for all bank fees, intermediary bank fees, blockchain network fees, exchange-rate costs, payment service fees, and other payment-related charges unless otherwise agreed in writing.

For cryptocurrency payments, the order value is based on the agreed invoice currency amount at the time of payment. First Game Limited is not responsible for cryptocurrency price fluctuations, blockchain delays, network fees, exchange-rate changes, or third-party payment costs.

7. No General Returns

Due to the nature of international B2B transactions and the high cost of international shipping, First Game Limited generally does not accept returns.

Returns are only accepted if First Game Limited has approved the return in writing before the goods are sent back.

Any goods returned without our prior written approval may be rejected and will not be eligible for refund, replacement, exchange, or credit.

Change-of-mind returns are generally not accepted.

8. Pre-Dispatch Photo and Video Confirmation

Before dispatch, First Game Limited may provide photos and/or videos of the goods for buyer confirmation.

The confirmation materials may show:

  • Product appearance
  • Product color
  • Quantity
  • Packaging condition
  • Customization details
  • Visible order information

Once the buyer confirms the goods for dispatch, the order will be considered accepted for the visible details shown in the confirmation materials.

This does not exclude valid claims for hidden defects, wrong shipment, or issues that could not reasonably be identified from the pre-dispatch confirmation materials.

9. After-Sales Claims and Evidence Requirement

The buyer should inspect the shipment immediately after delivery.

For any claim involving damaged goods, missing items, wrong items, packaging issues, or visible defects, the buyer must contact First Game Limited within 3 calendar days after delivery.

The buyer must provide sufficient evidence, including:

  • Order number or invoice number
  • Clear photos of the issue
  • A clear and continuous open-box video
  • Photos of the shipping label
  • Photos of the outer packaging
  • Photos of the inner packaging
  • A clear description of the issue

The open-box video should show the unopened package, shipping label, outer packaging, inner packaging, and the product issue.

If the buyer cannot provide sufficient evidence, especially an open-box video where reasonably required, First Game Limited may reject or limit the claim.

10. After-Sales Solutions

After receiving sufficient evidence, First Game Limited will review the case and negotiate a reasonable after-sales solution with the buyer.

Possible solutions may include:

  • Replacement parts
  • Replacement goods in a future shipment
  • Repair support
  • Technical guidance
  • Discount on a future order
  • Store credit
  • Partial refund
  • Full refund, only where appropriate and agreed by First Game Limited
  • Other commercially reasonable solutions agreed by both parties

After-sales solutions are handled case by case and must be confirmed in writing.

11. Customs Clearance Responsibility

The buyer is responsible for all customs clearance matters in the destination country or region unless otherwise agreed in writing.

This includes, but is not limited to:

  • Ensuring the goods can be legally imported into the destination country or region
  • Providing accurate shipping and import information
  • Handling customs clearance procedures
  • Providing required import documents if requested by customs, carrier, or broker
  • Communicating with the carrier, customs broker, or local customs authority when required
  • Paying any applicable import duties, import VAT, tariffs, customs fees, brokerage fees, taxes, storage fees, or other local charges

First Game Limited is not responsible if the goods are delayed, rejected, returned, confiscated, seized, destroyed, or otherwise unable to pass customs clearance due to destination-country regulations, buyer-side import restrictions, missing buyer documents, unpaid import charges, or any other customs-related issue outside our control.

If the buyer refuses delivery, fails to complete customs clearance, provides incorrect shipping information, fails to provide required documents, or fails to pay required import charges, any resulting loss, delay, return shipping cost, storage fee, customs charge, handling fee, or product loss shall be the buyer’s responsibility.

12. Import Compliance and Local Regulations

The buyer is responsible for checking whether the ordered goods can be legally imported, sold, distributed, modified, or used in the destination country or region.

First Game Limited is not responsible if the goods are restricted, rejected, detained, seized, destroyed, or returned by customs or other authorities due to destination-country laws, regulations, import restrictions, intellectual property concerns, product compliance requirements, or buyer-side import limitations.

The buyer is also responsible for ensuring that the purchase, resale, distribution, modification, marketing, and use of the products comply with applicable local laws and regulations.

13. Shipping Risk and Buyer-Appointed Forwarders

Unless otherwise agreed in writing, delivery risk transfers to the buyer once the goods are handed over to the carrier, logistics provider, or buyer-appointed freight forwarder.

If the buyer uses their own freight forwarder, shipping agent, warehouse, or logistics provider, the buyer is responsible for confirming that the forwarder can properly accept, handle, export, ship, and deliver the goods.

Once the goods are handed over to the buyer-appointed forwarder or logistics provider, First Game Limited is not responsible for any loss, damage, delay, customs issue, delivery failure, or additional cost caused by that forwarder or logistics provider.

14. Force Majeure and Events Beyond Our Control

First Game Limited shall not be liable for any delay, loss, damage, failure of delivery, non-performance, or partial performance caused by events beyond our reasonable control.

Such events may include, but are not limited to:

  • War, conflict, military action, terrorism, or civil unrest
  • Natural disasters, extreme weather, earthquake, flood, fire, epidemic, or pandemic
  • Government orders, sanctions, import/export restrictions, customs policy changes, or regulatory actions
  • Port congestion, carrier suspension, shipping route disruption, logistics interruption, or transportation accidents
  • Labor strikes, shortage of transportation capacity, power failure, or other events beyond our control

If any such event affects production, shipment, delivery, customs clearance, or performance of an order, First Game Limited will try to communicate with the buyer and assist where commercially reasonable.

However, any delay, additional cost, loss, seizure, destruction, or failure of delivery caused by such events shall not be the responsibility of First Game Limited unless otherwise agreed in writing.

15. Customer-Provided Designs, Logos, and Materials

If the buyer provides any logo, artwork, design file, image, brand name, trademark, reference, specification, or other material to First Game Limited, the buyer confirms that:

  • The buyer owns or has the legal right to use such materials;
  • The materials do not infringe any third-party intellectual property rights;
  • The materials do not violate any law or regulation;
  • The buyer has authority to request production, printing, customization, or modification based on such materials.

The buyer is fully responsible for any claim, dispute, loss, damage, cost, or legal issue arising from customer-provided materials.

First Game Limited reserves the right to refuse or cancel any order that may involve intellectual property concerns, legal risks, restricted products, or inappropriate content.

16. Third-Party Brands and Compatibility

Any third-party brand names, trademarks, product names, or model names mentioned on our website or in our communications are used only for identification, compatibility, or reference purposes.

First Game Limited is not affiliated with, endorsed by, sponsored by, or officially connected with any third-party brand owner unless expressly stated in writing.

All third-party trademarks are the property of their respective owners.

The buyer is responsible for ensuring that the purchase, resale, distribution, modification, import, export, marketing, and use of the products comply with applicable laws and third-party rights in the buyer’s destination country or region.

17. Installation, Modification, and Handling

Product shells may require professional handling, installation, disassembly, repair, or modification.

The buyer is responsible for ensuring that installation, modification, repair, or use is performed correctly.

First Game Limited is not responsible for damage caused by:

  • Incorrect installation
  • Disassembly
  • Repair attempts
  • Modification
  • Misuse
  • Improper storage
  • Improper handling
  • Third-party installation or service
  • Customer-side assembly mistakes

18. Limitation of Liability

To the maximum extent permitted by applicable law, First Game Limited shall not be liable for any indirect, incidental, special, consequential, punitive, or commercial loss.

This includes, but is not limited to:

  • Loss of profit
  • Loss of revenue
  • Loss of business opportunity
  • Loss of resale value
  • Loss of customers
  • Loss of reputation
  • Loss caused by shipping delay
  • Loss caused by customs clearance failure
  • Loss caused by installation or modification
  • Loss caused by buyer-side resale or market issues
  • Loss caused by third-party carriers, forwarders, customs brokers, or authorities

To the maximum extent permitted by applicable law, First Game Limited’s total liability for any order shall not exceed the amount actually paid by the buyer for the specific goods giving rise to the claim, excluding shipping fees, customs fees, duties, taxes, payment fees, and other third-party charges.

19. Relationship With Other Policies

This Business Customer Policy should be read together with our other website policies, including:

  • Terms of Service
  • Shipping Policy
  • Refund & Returns Policy
  • Privacy Policy
  • Any quotation, invoice, written agreement, or order confirmation issued by First Game Limited

If there is any conflict between this Business Customer Policy and a specific written agreement confirmed by First Game Limited, the specific written agreement shall prevail for that transaction.
